Our employee in Spain is limited to 30 hours a week. Can we extend their work permit to 40 hours?

Answer: Permit extension cannot be done as an amendment to the existing permit. The 30-hour ceiling is a condition of the study stay itself under Article 57 of RD 1155/2024, and Extranjería has no procedure to raise it. Full-time work requires a change of status: either a modification to residence and work under Article 190, filed by the employer at the provincial Extranjería office, or a Highly Qualified Professional permit filed at UGE-CE. The detail most employers miss is timing. Under Article 190.7, admission of the file to processing already grants a provisional full-time residence and work authorisation, so the employee can move to 40 hours before final approval rather than after it.

Moving a 30-hour employee in Spain to full time

La situación jurídica

The 30-hour cap is not a condition an office can adjust. It attaches to the study stay itself under Article 57 of RD 1155/2024, which permits work up to 30 hours a week alongside the studies. There is no procedure to raise it, so an hours-increase request is treated as wrongly filed.

Full time means a change of status: modification to residence and work under Article 190, or a Highly Qualified Professional permit under Law 14/2013 at UGE-CE. Article 190 files are exempt from the labour market test, so the authorisation granted carries no occupation or regional restriction. Provincial offices differ in the home-country criminal record evidence they expect and in how fast they issue the admission document.

La solución alternativa

The employer files at the Extranjería office of the province where the work is performed, telematically through Mercurio. Article 190.7 is the provision that matters: once the file is admitted to processing, the employee holds a provisional full-time residence and work authorisation until resolution. Admission, not final approval, is the date payroll can move to 40 hours. Admission usually takes days to three weeks depending on the office, resolution runs one to three months, and the TIE appointment adds several weeks after Social Security registration. Filing must fall in the two months before or three months after the study stay expires or the qualification issues, which also keeps the current status valid.

What proof does payroll need before switching the employee to 40 hours?

The admission-to-processing notification from Extranjería, which should state the provisional residence and work authorisation for full-time employment and reference the employee's NIE. Keep it alongside the contract novation and the Social Security filing. A bare submission or fee receipt without that wording does not evidence the right to work full time.

Does a Moroccan employee need a criminal record certificate from Morocco?

Usually yes, apostilled and translated by a sworn translator, covering countries of residence over the previous five years. Practice varies: some offices accept the Spanish certificate alone where the employee has been resident throughout their studies. Order the Moroccan document early, since issuance and legalisation rarely move quickly.

What if the employee studied in Spain on a government scholarship?

Article 190 excludes anyone funded by a Spanish or home-country scholarship under development cooperation or humanitarian aid programmes. The point is evidenced by a certificate from the origin-country authority or, where that cannot be obtained, a responsible declaration. An inaccurate or incomplete declaration is grounds for refusal.

The business needs full-time hours now but the employee graduates in a few months. What are our options?

Nothing can be filed under Article 190 until the qualification or certificate actually exists. The realistic choices are to wait, or to file a Law 14/2013 permit at UGE-CE where the employee already holds an earlier degree or comparable experience. Plan the commitment around the certificate issue date, not the graduation ceremony.

The employee already worked several 40-hour weeks before anyone checked. What should we do?

Return them to 30 hours immediately, correct the Social Security record from that date forward rather than backdating anything, and document internally when the error was found and fixed. A corrected and documented record is treated very differently at renewal or on inspection than one that looks concealed.

Does it matter which province we file the modification in?

Yes. The file goes to the Extranjería office of the province where the work is performed, and offices differ in how quickly they issue the admission document that unlocks full-time work. Where an employee could credibly be based in more than one province, that choice moves the start date. Confirm local practice first.

Once the permit is granted, can we move the employee to another office or change their role?

Generally yes. Because this route does not pass through the national employment situation test, the authorisation issued is not tied to one occupation or region, unlike permits granted after a labour market test. Internal transfers and role changes are therefore simpler, though a change of employer remains a separate filing.
